Acceptance of Terms

Please read these Terms carefully before using the Service. If you do not agree with any part of these Terms, you must not use the Site or the Service. These Terms constitute a legally binding agreement between you and Happy Horse 1.0.

Service Description

Happy Horse 1.0 is an AI-powered video generation platform. We provide technology, infrastructure, and support for creating AI-generated videos. The Service is provided "as is" and "as available" without warranties of any kind.

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. If you use the Service on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms.

Account Registration and Security

Use of the Service

License Grant

Prohibited Conduct

• Generate, upload, or share illegal, harmful, or abusive content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated systems (bots, scrapers) to access the Service without authorization
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Infringe upon intellectual property rights of Happy Horse 1.0 or third parties
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Use the Service for any unlawful purpose or in violation of applicable laws

User Content

Ownership and Responsibility

You retain all ownership rights in content you upload or generate through the Service ("User Content"). You are solely responsible for your User Content and represent that you have all necessary rights to use and share it.

License to Happy Horse 1.0

By submitting User Content, you grant Happy Horse 1.0 a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content solely to operate, provide, improve, and promote the Service. This license terminates when you delete your User Content or account, except where continued use is necessary for Service functionality.

Content Restrictions

You agree not to upload, generate, or share any User Content that:

• Is misleading, false, defamatory, or inaccurate
• Violates applicable laws, regulations, or third-party rights
• Infringes intellectual property, privacy, or publicity rights
• Contains unsolicited advertising, spam, or promotional materials
• Shares personal information of others without consent
• Contains explicit sexual, violent, or hateful content
• Is otherwise inappropriate, offensive, or harmful

Violation of these content restrictions may result in immediate suspension or termination of your account, removal of content, and potential legal action.

Intellectual Property Rights

All intellectual property rights in the Service, including but not limited to software, algorithms, models, designs, logos, and trademarks, are owned by Happy Horse 1.0 or its licensors. These Terms do not grant you any rights to use Happy Horse 1.0's trademarks, logos, or brand elements without prior written consent.

Payment and Subscription

Certain features of the Service require payment of fees. By subscribing, you agree to: (a) pay all applicable fees as described at the time of purchase; (b) provide accurate and complete payment information; (c) authorize us or our payment processors to charge your payment method. All fees are non-refundable except as expressly stated in our Refund Policy. We reserve the right to modify pricing with advance notice.

Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access to the Service immediately, without prior notice, for any reason, including but not limited to: (a) violation of these Terms; (b) fraudulent or illegal activity; (c) extended period of inactivity; (d) request by law enforcement. Upon termination, your right to use the Service will immediately cease, and we may delete your account and User Content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAPPY HORSE 1.0 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Happy Horse 1.0 and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party.

Dispute Resolution and Governing Law
